Sérgio Moro exercised the universal judgment of exception, partial and prevented, in indignity to the constitutional principles of jurisdiction, hierarchy, and fairness of the judiciary.

When he was the all-rounder judge of Lava Jato, Sergio Moro threw the weight of the State against whom he appointed the finger. He articulated support from part of the justice system (MPF, MPE, TRF-4, STJ, Federal Police) and state agents of the Federal Revenue Office, CGU, and TCU for their persecutory political purposes. 

The 13th Federal Court of Curitiba was instituted unconstitutionally, with the odd blessing of the Supreme Court – STF as an exception court – ex-post facto. Sérgio Moro exercised the universal judgment of exception, partial and prevented, in indignity to the constitutional principles of jurisdiction, hierarchy, and fairness of the judiciary.

The mainstream media created in society the climate of the guilt of the accused; The mass media forged a Court of Public Opinion to form the presumption of guilt of the deliberately chosen targets – invariably leaders and supporters of the Lula and Dilma governments. The “public opinion” in the monopolistic commercial media is strategic to crush and destroy the reputation of the selected enemies. 

All sorts of arbitrariness were celebrated as “fighting the corruption”: excessive prosecution, the kidnapping of property, hindering of wages, exoneration, extortion, expropriation, falsification of evidence, psychological, financial and moral torture, prosecution, trial and conviction without evidence, just conviction.

Illegalities were celebrated as supposed innovations in the “battle against crime” – coercive driving, temporary or temporary imprisonment for years on end to pluck denunciations in exchange for immoral benefits in favor of the whistleblower and to the satisfaction of the accuser. Due process, adversarial, broad defense, and fundamental human rights have been ignored, manipulated, or crushed.

In a strategically planned sequence, Lava Jato Operation worked with the lesser-known targets and without elective mandates that were part of the government of popular or “leftist” democracy such as Pizollato, Vaccari, and Delúbio. Then came the federal deputies João Paulo Cunha, Genoíno, and José Dirceu, this provisionally imprisoned indefinitely without any formal indictment as “The Chief”…

Moro helped overthrow the first woman in Brazil’s presidency – Dilma Roussef, unconstitutionally deposed. Finally, in a coup of lawfare, Moro stepped away from the election campaign Luís Ináscio Lula da Silva that was illegally arrested as a great trophy, nominated by prosecutors as the “Head of the Gang that Stole Brazil”. The mainstream media not only cheered or applauded, but they also remained part of the Lawfare freak show.

The State threw its machine against the PT (worker’s political party) and its allies: striking operations against politicians and supporters, lasting preemptive arrests, scandalous award-winning denunciations…

Moro did all this in exchange for the post of Minister of Justice of the neofascist government he helped elect and the promise of nomination to the Supreme Court… We do not know it for certain. For sure, Moro has been prepared by lawfare operators as a pre-candidate and wants running for president.

After 16 months in the actual (dis)government that created, complicit in the liquidation of Pre-Salt, the extinction of social security, CLT (Workers Code), spending cuts for health, education, and research, the dismantling of the state, privatization, geopolitical subservience, unemployment, organized crime, and illegal militias, Moro seems to be put out as a párea.

Now, Moro complains about the “disparity of weapons” between prosecution and defense. Moro feels the pain of facing the weight of an inhuman and neofascist persecutory state machine that he helped mold.

WHAT ARE THE LESSONS?

The lessons learned from all this: Moro represents and personifies Lawfare, which is the strategic use of law for political purposes. The government Bolsonaro is his child; that the creator carries the evil baby.

The mainstream media is the midwife of a rightest-wing government and a monstrous regime generated in the dungeons of the “Republic of Curitiba” – the Lawfare’s HQ – with support of foreign imperialism and the insidious Brazilian elites.

The right-wing in tatters, incompetent, irresponsible, and support of the misgovernment, take advantage regarding social isolation and despair before the Covid-19 pandemic, the hordes of the plagued by unemployment and hunger to impose its policy of cronyism, kleptocracy, and the dilapidation of national heritage richness and wellness.

PERSPECTIVES

The inevitable conclusion is that only the “people on the streets” can give a direction to the current political crisis. We need to reinvent politics, create new channels of protest, call on democratic and left-wing parties to fight on new battlefields. 

Time stand to unity in the struggle of all sectors and social segments affected by misgovernment. The approach is to defeat the right-wing actors and anti-constitutional militarism, neutralize the mainstream media and isolate the physiological center and uncover the scammers.

Raising a flag “Out Bolsonaro!” is not enough. We need a transparent government with moral legitimacy where Moro and Mourão and many others do not fit! Thus, the awareness about redoubling the care with the false opposition of Maia, Doria, Witzel, Caiado, Mandetta et caterva.

The real democratic and popular opposition passes through left-wing parties, social movements, conscientious, and “mobilized” citizens.

Brazil’s priority challenge is to overcome the pandemic of the virus and socioeconomic inequality with the inclusion of the millions of marginalized – black, poor, and peripheral.

The battlefield of the struggle is the promotion of democracy and the Brazilian civilizing framework.
